Assumption of Risk & Tactical Gear Liability Waiver

This page outlines the legally binding agreement between you (“the User”) and King David Media LLC, operating under the brand Shinobi_Bellator, regarding the purchase, possession, or use of any tactical, survival, emergency, or preparedness gear offered through ShinobiBellator.ninja.

By accessing this site, purchasing gear, or using equipment advertised, recommended, or linked through our platforms, YOU AGREE to the terms of this Assumption of Risk & Liability Waiver. If you do not agree, do not purchase or use any equipment from us.

1. High-Risk Activities & Real-World Gear

Shinobi_Bellator–branded gear is designed for serious, real-world use. Some equipment may involve inherent risks including but not limited to:

  • Fire, heat, blades, impact, and ballistic danger
  • Emergency, wilderness, or survival operations
  • Medical trauma response and first-aid scenarios
  • Heavy-duty load-bearing or tactical applications
  • Use in harsh, unpredictable, or life-threatening environments

You acknowledge these risks and willingly accept them.

2. No Guarantees of Safety or Fitness for Purpose

While our gear is curated with real combat-zone experience and survival standards, King David Media LLC makes no guarantees that any equipment:

  • Will prevent injury, death, or property damage
  • Will function in every situation or environment
  • Is appropriate for your skill level or physical condition
  • Is legal to possess or use in your region

You are solely responsible for evaluating whether any product is appropriate for you.

3. User Responsibility

You agree that YOU ALONE are responsible for:

  • Using gear safely, lawfully, and correctly
  • Following all manufacturer instructions
  • Maintaining awareness of local, state, and federal laws regarding tactical gear
  • Training properly before using advanced equipment
  • Ensuring your physical and mental readiness for high-risk activities

You agree NOT to hold King David Media LLC liable for your actions, decisions, training level, or lack thereof.

4. Assumption of Risk

You acknowledge and voluntarily accept ALL risks associated with tactical and survival gear, including:

  • Bodily injury or death
  • Equipment malfunction or misuse
  • Environmental hazards
  • Failure of third-party components or attachments
  • Training accidents or user error

YOU ACCEPT FULL RESPONSIBILITY for any harm that occurs during or after the use of the gear.

5. Limitation of Liability

To the maximum extent permitted by law, King David Media LLC and Shinobi_Bellator are NOT liable for:

  • Personal injury, death, or medical consequences
  • Loss, theft, or damage to property
  • Misuse or untrained handling of equipment
  • Legal consequences resulting from gear possession or use
  • Third-party manufacturing defects

Your purchase and/or use of tactical equipment constitutes a full release of liability.

6. No Duty to Warn

You acknowledge that tactical gear inherently involves danger. King David Media LLC has no obligation to warn you beyond what is already provided in manuals, packaging, or common sense.

7. Indemnification

You agree to defend, indemnify, and hold harmless King David Media LLC, including all owners, officers, employees, contractors, and affiliates, from ANY claims arising out of:

  • Your use or misuse of gear
  • Your violation of laws or regulations
  • Any injury, death, or loss resulting from your actions

8. Governing Law

This waiver is governed by the laws of the State of Oregon (Ninth Circuit jurisdiction), where artistic and expressive rights receive the highest free-speech protection.
